Navy Settles Child Brain Damage Lawsuit for $11.5 Million

A sailor who gave birth in a Navy hospital has received $11.5 million to settle a lawsuit that claimed the baby suffered brain injuries. According to the Virginian-Pilot, the child was born in Guam, where local laws don’t cap malpractice claims. Had the child been born in Virginia, where the parents are from, any award would have been capped at $2.15 million. Attorneys for the woman and her husband, who is also in the Navy, were happy with the settlement, saying that the government was reasonable with how it handled litigation. Court documents indicated that in 2014, the child was born at the U.S. Naval Hospital in Guam, where the couple was stationed there at the time.
