A woman had a fairly normal delivery in a New York hospital. She gave birth to an 8 pound, 10 ounce baby with few complications. However, after he was born, doctors noticed that the child had a very weak cry. They instantly took the child to the Neonatal Intensive Care Unit (NICU), and he remained there for three months. Doctors had to perform surgery to correct a problem with his diaphragm.
Now, the child suffers from quadriplegia, seizures and developmental problems. The suit alleges that the hospital sent her a notice after she took her child home. She was told that her son technically died for about an hour while he was in the NICU, and that he sustained multiple injuries while in hospital care, including:
- Gastroesophageal reflux disease
- Cardiorespiratory arrest
- Bilateral pneumothoraces
- Hypoxic ischemic encephalopathy
The mother filed a lawsuit against the hospital for its negligent care that resulted in permanent disability. Both parties eventually agreed to a $1,275,000.00 settlement.
