$144 Million Birth Injury Verdict Upheld
As we have reported several times in our blog, the failure of a medical provider to order a timely C-section can result in devastating injuries including brain damage and/or cerebral palsy. These injuries can require expensive rehabilitation and therapy, and lead to a lifetime of pain for the children and for family members. This is why damages awarded in birth injury lawsuits can be significant. Recently, a Michigan appeals court ruled in favor of a family who received a $144 million verdict following the botched delivery of a child. The child was reportedly large, but instead of giving the mother a C-section, doctors allowed a natural delivery. During the birth of the child, doctors reportedly used the drug Pitocin and the baby was forced through the birth canal of its mother, fracturing her clavicle and causing her to suffer multiple hemorrhages. Delivery Delays: How Can This Injure a Child?
Did you know that delays during delivery could result in a baby experiencing brain damage and/or cerebral palsy? Recently, a Florida jury awarded $8.4 million to the family of a boy who was diagnosed with cerebral palsy following birth complications. According to the Gainesville Times, a jury ruled that Northeast Georgia Medical Center was negligent in its handling of the boy who was injured in 2008. The paper reported that the boy, now 5, suffered from a delayed delivery, which required immediate resuscitation. However, a tube was not inserted into the boy’s mouth to revive him until eight minutes after he was born. The boy now uses a wheelchair and is unable to walk or talk. Cerebral Palsy: Family Awarded $20.6 Million After Botched Delivery
As we have reported in our blog previously, the failure of a healthcare provider to respond reasonably and accurately to situations that may arise during the birth of your child can have devastating consequences. Many birth injuries, including cerebral palsy, erb’s palsy and brain damage, are the result of doctor errors and/or issues with delays. It should be noted that issues like a delay in ordering a caesarian (C-) section or a physician erroneously using forceps or a vacuum extractor can result in a child suffering injuries that can haunt him or her for life. Sadly, this is not uncommon. Recently, a Maryland appeals court upheld a $20.6 million verdict for a family whose son was born with cerebral palsy.
