Maryland Jury Awards Record $229 Million for Brain Injury
A Maryland jury awarded a woman a record $229.6 million earlier this month after she claimed that her daughter suffered brain injuries during birth due to medical malpractice. According to the Baltimore Sun, the jury award is the largest medical malpractice award in the history of the United States, although it was capped at just over $200 million due to state laws. The mother claimed in her lawsuit against Johns Hopkins Bayview Medical Center that about five years ago, she was told by doctors that her baby would die or suffer brain damage as a result of her suffering from high blood pressure from preeclampsia. Brain Injury During Botched Birth Leads to Arizona Lawsuit
According to the Phoenix New Times, a woman is suing a healthcare provider saying her son was born with a skull fracture and permanent injuries due to negligence. The news source reports that the woman and her husband have filed a lawsuit in Arizona, arguing that doctors and nurses made numerous mistakes leading up to the birth of her child that have caused him lifelong disabilities. Her lawsuit indicates that the mother was young and petite, and was under the care of the same doctor throughout the course of her pregnancy. At 39 weeks, she claims the provider deemed her pregnancy non high-risk, although the doctor opted to induce labor. Mass. Family Awarded $30 Million for Child’s Brain Injury
A Massachusetts family was recently awarded $30 million after a child was born with significant brain injuries. According to the Boston Globe, the family filed a lawsuit against a nursing staffing agency, saying the provider failed to properly monitor the birth of the child during his delivery. The mother involved in the lawsuit was allegedly in labor and pushing for more than five hours, and her son was born with almost no heartbeat and was not breathing. The lawsuit claims that the medical team was not using a continuous fetal heart-rate monitor during the delivery. As a result, the family said the child suffered severe brain injuries, as an umbilical cord was wrapped around his neck during the delivery. The delivery occurred in 2013.
