Every second counts during the birth of a child. If doctors wait too long to make a decision, it can cause lifelong complications, disabilities and an early death for the child.
A birth injury lawsuit filed in Cook County alleges that a doctor’s delayed decision to order a C-section resulted in the death of a child just days after his birth. The mother blames the doctor responsible for the delivery and the VHS West Suburban Medical Center in Illinois for the newborn’s wrongful death.
She also claims that the hospital failed to warn her that a vaginal delivery might not be the best option for her due to a previous C-section. During labor, the lawsuit says the mother suffered a uterine rupture and a severe loss of blood. The doctor eventually decided to perform a C-section. Her son did not have a pulse when he was born, and he died at another hospital less than 10 days later.
The suit claims that the hospital staff did not adequately monitor the child’s heart rate, and when it did monitor the child’s vital signs, they should have noticed potential dangers and responded appropriately.
When the hospital is responsible for errors during childbirth, it can owe damages to compensate for pain, suffering and loss. When mistakes result in brain damage or serious disability, these damages can help pay for the child’s lifetime medical expenses.
