A six year old child who has been diagnosed with having severe autism was bitten at school by a substitute teacher. The substitute reportedly bit the child on the arm in the presence of two other teachers who reported the incident. Palm Beach County Schools have issued statements claiming that the situation is upsetting to them, and that this was the first time that particular substitute has worked in their district. An investigation is underway by both the school system and the police. According to the child’s mother he will not be returning to the school, she claims that he is very scared and while he cannot explain how he feels he won’t let anyone touch his hand where he was bitten. A birth injury lawsuit filed by his mother after her son was permanently disabled due to birth injuries has netted $60,000 to the mother for medical expense reimbursement, and the amount of $2.3 million in damages to the boy. This award will allow the boy to have medical care, assistance, and compensation for difficulties and challenges he will face as an adult. The defendants in the case included nurse-midwife Rhonda Bertholf, and the medical practice of Dr. Richard M. Valentine Jr. M.D.,PC. Because Valentine’s practice is associated with Bertholf he was named as a defendant in the birth injury malpractice suit even though he had no involvement in the actual delivery. January 19, 2011When Joshua Miller was accused of shaking his infant son so severely that it caused bleeding into the baby’s eyes and brain he was charged with aggravated assault, child endangerment, reckless endangerment and simple assault. In January of 2009 Mr. Miller and his son were home alone. Miller made a frantic call to 911 saying that his son was unresponsive and gasping for breath. Upon arrival at the hospital the baby was treated and transferred to the Children’s Hospital of Pittsburgh where he was kept for 7 days. When this case went to court it there were conflicting opinions in what could have caused the bleeding the infant’s brain.
