Delivery Delays: How Can This Injure a Child?

Posted on October 8, 2014 by Cappolino Dodd Krebs LLP

Did you know that delays during delivery could result in a baby experiencing brain damage and/or cerebral palsy? Recently, a Florida jury awarded $8.4 million to the family of a boy who was diagnosed with cerebral palsy following birth complications. According to the Gainesville Times, a jury ruled that Northeast Georgia Medical Center was negligent in its handling of the boy who was injured in 2008. The paper reported that the boy, now 5, suffered from a delayed delivery, which required immediate resuscitation. However, a tube was not inserted into the boy’s mouth to revive him until eight minutes after he was born. The boy now uses a wheelchair and is unable to walk or talk. Additionally, he requires a feeding tube. Keep in mind, issues like hypoxia occur when a region of the body is deprived of oxygen. This can result in lifetime or pain and rehabilitation. Why Should…

Cerebral Palsy: Family Awarded $20.6 Million After Botched Delivery

Posted on October 8, 2014 by Cappolino Dodd Krebs LLP

As we have reported in our blog previously, the failure of a healthcare provider to respond reasonably and accurately to situations that may arise during the birth of your child can have devastating consequences.  Many birth injuries, including cerebral palsy, erb’s palsy and brain damage, are the result of doctor errors and/or issues with delays. It should be noted that issues like a delay in ordering a caesarian (C-) section or a physician erroneously using forceps or a vacuum extractor can result in a child suffering injuries that can haunt him or her for life. Sadly, this is not uncommon. Recently, a Maryland appeals court upheld a $20.6 million verdict for a family whose son was born with cerebral palsy. The Maryland Daily Record reported recently that an appeals court upheld Shantiah and Joel Norfleet’s case. The Norfleet’s were awarded the money after their son Jaylan’s obstetrician failed to perform a prompt…

Birth Trauma Attorneys Look at an Exciting New Development Fetoscopy is a procedure performed which allows an obstetrician access to the developing fetus during pregnancy. A tiny incision is made in the mother’s abdomen, and a fetoscope—a long, wand-like instrument with a minuscule camera in its end—is inserted into the amniotic cavity. Using this method, a doctor can also monitor the umbilical cord and the fetal side of the placenta. Fetoscopy allows surgeons to check the fetus for anatomical abnormalities and makes medical intervention possible in cases of emergency. Unfortunately, a common problem in fetoscopy is the rupturing of the fetal membrane—the sac containing the developing baby—during the procedure. To make room for the fetoscope, a pathway to the fetal sac must be created using a device with a sharp tip. Far too often, this tool punctures the fetal membrane, which can cause a leak of amniotic fluid. This in…
