The Maryland obstetrics and gynecological (OB/GYN) community faces several million-dollar medical malpractice lawsuits for damages resulting from complications during birth. A new bill proposes the formation of a fund to pay for medical bills, lost earnings and other damages of families who have suffered birth traumas. The bill’s detractors claim that such a fund would absolve OB/GYNs of responsibility for their negligent care. “The best way for hospitals to reduce their financial burden is to prevent negligence,” said the founder of the Coalition for Patients’ Rights in Maryland. “A birth injury fund will only serve to remove accountability and thereby increase likelihood of negligence.” What Does A Birth Injury Fund Mean For Parents? Illinois Woman Files Lawsuit After Child Born With Shoulder and Arm Problems
May 14, 2014According to the Madison-St. Clair Record, a woman in Illinois has filed a lawsuit against a hospital claiming that its doctors were reckless and caused irreparable damages to her newborn child. The news outlet reported that Sarah Waller filed a lawsuit against Anderson Hospital after her child Clayton became stuck during his August 2011 delivery. According to the lawsuit, Waller said that doctors at the hospital failed to estimate Clayton’s weight prior to his birth, resulting in a delayed delivery. Waller also claims that she was not offered a C-section delivery and that the excess pressure applied to Clayton during his birth resulted in permanent nerve damage in his shoulder and extreme pain. Houston Couple Left Waiting For Months to Discover Birth Injury Killed Child
May 7, 2014According to KPRC-TV, a Houston couple was left searching for answers after their newborn child died just four days after birth. The news outlet reported that Allen Coats and his fiancée Rachel Melancon had a child, Olivia, who was delivered at the Medical Center of Southeast Texas in Houston. However, during birth the baby suffered complications and was rushed by Life Flight to Memorial Hermann Hospital, where Olivia died. It was discovered by the couple that the doctor who delivered Olivia at the Medical Center of Southeast Texas was relieved of his duties about a month after her birth. Unsure as to how Olivia died, the couple sought an autopsy to determine why. However, the couple was forced to wait four months while Memorial Hermann completed the autopsy, according to KRPC.
