After Traumatic Birth, Mother Receives $1.2 Million Settlement
A woman had a fairly normal delivery in a New York hospital. She gave birth to an 8 pound, 10 ounce baby with few complications. However, after he was born, doctors noticed that the child had a very weak cry. They instantly took the child to the Neonatal Intensive Care Unit (NICU), and he remained there for three months. Doctors had to perform surgery to correct a problem with his diaphragm. Now, the child suffers from quadriplegia, seizures and developmental problems. The suit alleges that the hospital sent her a notice after she took her child home. She was told that her son technically died for about an hour while he was in the NICU, and that he sustained multiple injuries while in hospital care, including: Gastroesophageal reflux disease Cardiorespiratory arrest Bilateral pneumothoraces Hypoxic ischemic encephalopathy The mother filed a lawsuit against the hospital for its negligent care that resulted…

Birth Trauma Attorneys Honor National Birth Defects Prevention Month of 2013
The National Birth Defects Prevention Network (NBDPN) designated January as National Birth Defects Prevention Month. According to its website, NBDPN is a “group of individuals involved in birth defects surveillance, research and prevention.” Throughout January, the group has worked to spread knowledge about birth injuries, birth defects and methods we can use to prevent them. This year’s theme is “Birth Defects: Common, costly and critical.” The site offers sobering statistics about the prevalence of birth defects, including: For every 33 births, one will have a birth defect One of every five children who die before their first birthday suffer from a birth defect Each year, more than 120,000 babies are born with birth defects There are many factors that cause birth defects. Girl Born in Jail Suffers Birth Trauma Injuries
Wayne County has recently settled a birth trauma lawsuit filed by a woman who gave birth in jail. Chantrienes Barker went into labor in 1998 while incarcerated. Officers sent her to a hospital, but returned her to jail just two hours later. She and other inmates repeatedly urged guards to return her to the hospital, saying that her labor pains were increasing. She gave birth in jail, and her daughter now suffers from brain damage. Barker sued the county for violating her civil rights, and the county agreed to an $8 million settlement. The County’s Defense Initially, the county said that it was not responsible for the infant’s health due to a landmark abortion ruling. Since Roe V. Wade decided that life did not begin before birth, the county argued, jail officials had no responsibility to provide adequate care to Barker’s unborn child.
