Girl Born in Jail Suffers Birth Trauma Injuries
Wayne County has recently settled a birth trauma lawsuit filed by a woman who gave birth in jail. Chantrienes Barker went into labor in 1998 while incarcerated. Officers sent her to a hospital, but returned her to jail just two hours later. She and other inmates repeatedly urged guards to return her to the hospital, saying that her labor pains were increasing. She gave birth in jail, and her daughter now suffers from brain damage. Barker sued the county for violating her civil rights, and the county agreed to an $8 million settlement. The County’s Defense Initially, the county said that it was not responsible for the infant’s health due to a landmark abortion ruling. Since Roe V. Wade decided that life did not begin before birth, the county argued, jail officials had no responsibility to provide adequate care to Barker’s unborn child. Family Receives $4M Settlement in Birth Trauma Lawsuit
A family in Rhode Island received a $4 million settlement from a hospital that they claim made decisions immediately after the birth of their child that led to his permanent brain damage. According to the birth trauma lawsuit, the birth was normal. The child did not respond to breastfeeding, so the doctor asked nurses to feed the child formula. They did not adhere exactly to the doctor’s orders, and the baby suffered a hypoglycemic episode. The parents say the episode caused brain damage that lead to continuing problems with vision, tactile sensory disorders and developmental issues. The child is now seven years old and still experiences these issues. By ignoring warning signs and risk factors of hypoglycemia such as low birth weight and poor response to breastfeeding, the parents say the hospital is responsible for their child’s current difficulties. Couple Says Doctor Decapitated Newborn During Birth
A recent lawsuit filed by Arteisha Betts and Travis Ammonette says a doctor went to grotesque lengths to cover up the accidental death of their newborn son in the delivery room. The lawsuit claims that the doctor pulled too hard on the infant’s head during delivery, causing the head to detach from the body. To cover up the mistake, they say he then forced the baby back inside Betts and ordered an emergency cesarean section, or C-section. Prior Warnings At an earlier appointment, a physician told the couple that due to the baby’s size, Betts would likely need to give birth via C-section. When it came time to deliver, however, Dr. Gilbert Webb of St. John’s Mercy Medical Center would only perform a C-section after attempting a vaginal birth.
