Mother Claims Doctor’s Inattentiveness Led to Newborn’s Cerebral Palsy

A mother in Florida claims the failure of doctors to promptly treat her during labor led to serious and permanent birth injuries for her child. According to the lawsuit, the mother visited the Indian River Medical Center in Palm Beach complaining of vaginal leakage. Hospital staff diagnosed the woman with premature rupture of membranes and transferred her to St. Mary’s Medical Center. The mother was admitted to St. Mary’s that same day, and was assigned to the attending obstetrician. The obstetrician wrote orders to continue fetal heart monitoring and began administration of antibiotics. On one occasion, a flush of the mother’s IV lines was performed. According to the lawsuit, a substance known as Cathflow was used by a nurse to flush the line. Mother’s Cesarean Section Goes Wrong, Texas Family Files Brain Injury Lawsuit

A couple in Texas filed a brain injury lawsuit, stating that their child suffered severe and permanent injuries during and after the mother’s delayed Cesarean section. According to the lawsuit, hospital staff failed to provide the required facilities for the mother’s emergency C-section, which caused the newborn to sustain permanent brain damage. The mother was forced to wait for an available operating room, as the hospital failed to provide a surgical suite in a timely manner for her emergency C-section. The mother stated that the physicians who facilitated her childbirth had a duty to provide a competent degree of skill and supervision, yet failed to offer a standard level of medical care.  The parent’s lawyers stated that by failing to fully inform the mother of the risks and complications of delaying a Cesarean section during a difficult labor, the hospital staff showed extreme medical negligence. Parents Receive $74 Million in Malpractice Lawsuit against Doctor

In April, a jury in California awarded a couple more than $74 million against a doctor on behalf of their daughter, finding the physician negligent during delivery of their child, which resulted in the baby developing cerebral palsy. During the trail, the couple’s attorney presented evidence that the baby’s heart rate was fluctuating wildly and the doctor did not hasten the birth or conduct a proper examination of cord blood during delivery. After two days of deliberation, the jury found that the physician was responsible for the botched delivery. After the verdict, several jurors hugged the family, who watched over the 3-year-old girl who sat in a stroller with a harness holding her in. The jury said the case struck a chord with them emotionally and that the evidence aided in their decision to award the family $74,225,000.
