Parents File $50 Million Birth Injury Suit Against Hospital

Each moment counts when delivering a baby, especially when things start to go wrong. A recent federal tort lawsuit filed in California alleges that one hospital’s mistake caused $50 million worth of permanent brain damage to a child. When Stefanie Davis went into labor in January of 2010, doctors determined that a vaginal birth was out of the question due to the baby’s position. The attending physician performed a C-section with a vacuum extraction, which many health experts acknowledge poses certain health risks to the baby. The procedure involves placing a small vacuum on the baby’s head to aid its removal from the womb. After removing the baby, nurses noticed signs of distress on the child where the doctor applied the vacuum, such as bruising, swelling and hemorrhaging. Severe Brain Injury for Newborn with Dislodged Feeding Tube

Summer Hawcroft was born prematurely to Steven and Michaela Hawcroft of Kendray in the UK on April 23, 2011. She died in her mother’s arms 49 days later. An ongoing lawsuit blames a mistake by doctors at the Barnsley District Hospital. When her breathing tube was disconnected, it deprived Summer of much needed oxygen while she was in the neo-natal unit. The lawsuit says this lack of oxygen caused a traumatic brain injury, which led to her early death. ‘A Combination of Factors’ Summer needed resuscitation after birth, according to pediatrician Dr. Ash Kale. She was placed in an incubator and fitted with a breathing tube. An independent doctor testified that another breathing tube would have been more appropriate, and Kale admitted that he’d received no training regarding incubation. Newborn Suffers Brain Injury After Hospital Delays Resuscitation

Nala Myers is three years old. She cannot walk or talk. She needs a feeding tube to eat. She will require assistance for the rest of her life. She had a difficult birth. When she was born, her heart was beating, but she was not breathing. A lawsuit filed by Tierra Myers, Nala’s mother, says that the hospital acted negligently in the critical five minutes following her birth, ultimately causing a brain injury. Most hospitals record an Apgar score one minute and five minutes after delivery. Apgar scores monitor breath, heart rate, muscle tone, response to stimulation and appearance. In this case, the lawsuit claims that whoever performed the one-minute Apgar score fudged the numbers to make Nala’s condition seem healthier than it was.
