According to the Associated Press, Congress has passed the ABLE Act, which allows for people with disabilities to save money and open tax-free savings accounts. The bill is the most “sweeping legislation to help the disabled in a quarter century.” The bill has received bipartisan support, as Senate passed the measure by a 76-16 vote and the House passed it by an overwhelming majority, 404-17. “This is a monumental, landmark bill,” said Sara Hart Weir, the interim president of the National Down Syndrome Society, according to the AP. Brain Injury: Kentucky Family Awarded $18 Million Following Botched Delivery
Did your child suffer a terrible brain injury during his or her birth? If so, you need to hold your medical care provider liable. A jury has awarded the family of a child who suffered a brain injury during birth in Glasgow, Kentucky $18 million, according to the Associated Press. The news outlet reported that the jury reached its decision on November 25, finding that T.J. Samson Community Hospital was responsible for medical negligence in the botched delivery of Tristan Hamilton. Hamilton’s family said that he was born with cerebral palsy and other health issues after his birth in 2007. It claimed that the drug Pitocin, which is commonly used to induce labor, was used incorrectly, according to the AP. Forceps: What Are the Risks During Delivery?
If your doctor uses forceps at the wrong stage of labor, your baby can suffer a brain injury, bruising, permanent indentations, cranial damage, excessive blood loss or cephalohematoma. It can also experience disfigurement or total disability. In a sad case out of Europe, a child who suffered eye injuries during a forceps delivery was awarded €198,000 in damages. The girl will reportedly have to wear glasses temporarily, as she suffered cuts to her eye, which swelled after her birth. A judge ruled that the use of forceps during her delivery was inappropriate and done incorrectly. The girl also reportedly suffers from permanent scarring under her eye.
