Massachusetts Midwife Settles Cerebral Palsy Lawsuit

Jeanne Browne, a midwife from Concord, Massachusetts, settled a $730,000 lawsuit with a family whose child suffered a severe brain injury during a birth that Browne supervised. According to the Concord Monitor, Sarah and Jonathan Sadowski’s daughter remained in the hospital for 21 days following her birth in January 2009, and she now has cerebral palsy. Browne surrendered her license after her investigation by the state Midwifery Council last June. Several hospitals in the area filed complaints about Browne’s failure to consult with obstetricians about high-risk pregnancies, though Browne stated that she stood by her decisions. The Sadowskis also stated that Browne did not manage their pregnancy appropriately, since Sarah Sadowski had several risk factors and the midwife did not refer her to an obstetrician. Family Sues Hospital For Son’s Multiple Disabilities and Cerebral Palsy

According to the Herald Sun, the family of a young boy born with cerebral palsy is suing Queensland Health alleging the hospital staff who managed the birth were responsible for his disability. The family of six-year-old Dylan Wallace filed a lawsuit against the hospital claiming the staff failed to respond quickly to signs of distress in the womb. For at least an hour preceding his birth, the infant was starved of oxygen to his brain and consequently it lead to his cerebral palsy. The birth injury left Dylan with profound physical and intellectual disabilities, including quadriplegia, severe developmental delay and visual impairment. Dylan cannot move or speak and is fed through a tube into his stomach. Jury Agrees Girl’s Cerebral Palsy Caused By Doctor Negligence

According to the Law Firm Newswire, an Atlanta jury recently agreed with a family that their daughter’s cerebral palsy was a direct result of negligence on part of the doctor and awarded them a multi-million dollar injury award. The birth injury lawyer representing the family called it a disturbing case with clear signs that could have avoided the results, if the medical professionals had acted promptly on symptoms of a baby in distress. At trial, the jury heard the story of how an expectant mother-to-be went for her regular checkups and the results of her non-stress test showed herb baby had a low heart rate. The doctor suggested that labor be induced and the parents agreed to go ahead with an emergency c-section.
