Family Settles $9 Million Cerebral Palsy Lawsuit With Hospital

According to the Associated Press, the family of a Virginia boy who was birthed in a Hawaii military hospital has reached a $9 million settlement with the facility after he was born with cerebral palsy. According to the AP, the settlement was recorded in a federal court in Honolulu on January 27, only needing the approval of the U.S. Department of Justice before being awarded. In a lawsuit, the family of Noah Whitney claims he was born in 2010 at Tripler Army Medical Center with a “catastrophic brain injury” because of negligence on the part of the facility. The family alleged that healthcare providers failed to respond appropriately to signs and symptoms of uterine rupture in Noah’s mother and took too long to perform a cesarean section. Fort Hood Family Sues Government Over Son’s Birth Injuries

According to the Killeen Daily Herald, the parents of a child born with severe birth injuries at a military hospital at Fort Hood have settled their lawsuit against the U.S. government for $6.5 million. The paper reported that Kassie and Higinio Rivera filed a lawsuit against Darnall Army Medical Center in U.S. District Court for the Western District of Texas, located in Austin, following the birth of their son on September 12, 2008. The lawsuit alleged that doctors at the hospital ignored evidence that Kassie’s contractions were over stimulated due to the excessive use of “oxytocin causing severe distress in the baby and the need for immediate delivery by caesarean section.” Following his birth, Haiden was diagnosed with severe brain injuries and cerebral palsy. Preterm Boys at Higher Risk for Death and Disabilities

According to ScienceDaily, a global study on preterm birth and disability carried out by almost 50 researchers and 35 institutions found that baby boys are at a higher risk of death and disability due to preterm birth than girls are. The news service reported that a report in Pediatric Research indicated that boys are 14 percent more likely to be born preterm than girls are. “Baby boys have a higher likelihood of infections, jaundice, birth complications, and congenital conditions, but the biggest risk for baby boys is due to preterm birth. For two babies born at the same degree of prematurity, a boy will have a higher risk of death and disability compared to a girl.
