Couple Awarded $50 Million Following Botched Newborn Genetic Testing

As we reported last December, botched genetic testing is becoming a concern in the medical community when dealing with newborns. According to the Seattle Times, a Washington jury awarded a couple $50 million after its son was born with profound mental and physical disabilities after two providers mishandled a genetic test. The Times reported that Brock and Rhea Wuth were told they had a 50-50 chance of having a child with a defect or a related translocation, so they sought out genetic testing before the child’s birth. After which, their son, Oliver, born in July 2008, was deemed normal. However, after the child was born, the family found out he had genetic defects, which led to disabilities. In a lawsuit, the family said that Valley Medical Center in Renton and Laboratory Corporation of America (LabCorp), based in North Carolina botched a prenatal test prior to Oliver’s birth. Fort Hood Family Sues Government Over Son’s Birth Injuries

According to the Killeen Daily Herald, the parents of a child born with severe birth injuries at a military hospital at Fort Hood have settled their lawsuit against the U.S. government for $6.5 million. The paper reported that Kassie and Higinio Rivera filed a lawsuit against Darnall Army Medical Center in U.S. District Court for the Western District of Texas, located in Austin, following the birth of their son on September 12, 2008. The lawsuit alleged that doctors at the hospital ignored evidence that Kassie’s contractions were over stimulated due to the excessive use of “oxytocin causing severe distress in the baby and the need for immediate delivery by caesarean section.” Following his birth, Haiden was diagnosed with severe brain injuries and cerebral palsy.
