The loss of a child is not something any amount of money can help a family recover from. Unfortunately, the death of a child during a delivery can be devastating emotionally for all parties involved. A family preparing itself mentally to have a child, and then having that life taken away, is unfathomable. This is why healthcare providers must be held liable whenever negligence contributes to the death of a baby. Recently, a woman in New Jersey filed a lawsuit against a hospital and its attending staff after her son was pronounced dead after its birth. The woman claimed in her filing that she should have been offered a cesarean birth following labor difficulties. The child, which was delivered in 2010, reportedly weighed 10 pounds, making him too large to be delivered via vaginal delivery. Can You Sue Your Medical Provider If Your Child Dies Following Its Birth? Inmate Files Lawsuit after Alleged Botched Delivery
According to the Wichita Times Record News, a woman who was being held on drug charges in a county jail in Texas has filed a lawsuit after she delivered a baby who died while she was in solitary confinement. The newspaper reported that Nicole Guerrero is suing Wichita County, Sheriff David Duke, Correctional Healthcare Management, Inc. and Ladonna Anderson for breaching the duty of care owed to her, and for medical malpractice. Guerrero was being held in the Wichita County Jail in 2012 on a drug possession charge and was pregnant at the time. On June 11, she reportedly went to a doctor and was told the child had no complications. She was prescribed a medication and supplement by the doctor. Houston Couple Left Waiting For Months to Discover Birth Injury Killed Child
According to KPRC-TV, a Houston couple was left searching for answers after their newborn child died just four days after birth. The news outlet reported that Allen Coats and his fiancée Rachel Melancon had a child, Olivia, who was delivered at the Medical Center of Southeast Texas in Houston. However, during birth the baby suffered complications and was rushed by Life Flight to Memorial Hermann Hospital, where Olivia died. It was discovered by the couple that the doctor who delivered Olivia at the Medical Center of Southeast Texas was relieved of his duties about a month after her birth. Unsure as to how Olivia died, the couple sought an autopsy to determine why. However, the couple was forced to wait four months while Memorial Hermann completed the autopsy, according to KRPC.
