Do People Who Suffer From Birth Injuries Face Employment Discrimination?

Aside from grueling forms of therapy and rehabilitation, many people who suffer birth injuries also have to overcome other hurdles in life—including discrimination. image-wheel2

It should be noted that many birth injuries, including cerebral palsy, erb’s palsy and brain damage, are the result of doctor error. Many of these injuries result in intellectual limitations, hearing deficits, vision impairment, behavioral problems, seizures, speaking difficulties and learning disabilities.

Unfortunately, for many victims, there are obstacles associated with employment later in life, including facing discrimination in the workplace, as limited motor skills and abilities may leave them bullied.

Recently, Barclays Center, located in New York City, was hit with a lawsuit over allegations that five food service employees at the arena were discriminated against based on their disabilities.

One man, who is blind in one eye, was allegedly ridiculed by employees, who called him “Cyclops” and consistently bullied him. Additionally, another man, who suffers from cerebral palsy and rhinophyma, was mocked by a manager who imitated his disabilities.

The lawsuit also claims that a Barclays Center consultant allegedly relocated employees with disabilities “to ensure that they remain out of the sight of customers” and specifically mentioned that she did not want the disabled employees mentioned above to be “in sight,” the New York Daily News reported.

The allegations are abhorrent; it is our hope that these workers will be compensated for any wrongdoing that may have occurred. People with disabilities should not have to face discrimination at work—it is sad that people who are dealing with these obstacles are allegedly being bullied for their disabilities.

Can I File a Lawsuit If My Child Has Cerebral Palsy?

Unfortunately, many people who suffer from birth injuries face a lifetime of obstacles, including harassment. That is why it is important to hold a doctor or medical provider liable if he or she is responsible for your child’s birth injuries.

As we have noted in previous blogs, birth injuries can occur when a medical provider fails to act quickly to protect the child from ensuing complications. Issues like a delay in ordering a caesarian (C-) section or a doctor improperly using forceps or a vacuum extractor can result in a child suffering injuries that can haunt him or her for life.
