According to the Herald Sun, the family of a young boy born with cerebral palsy is suing Queensland Health alleging the hospital staff who managed the birth were responsible for his disability. The family of six-year-old Dylan Wallace filed a lawsuit against the hospital claiming the staff failed to respond quickly to signs of distress in the womb. For at least an hour preceding his birth, the infant was starved of oxygen to his brain and consequently it lead to his cerebral palsy.
The birth injury left Dylan with profound physical and intellectual disabilities, including quadriplegia, severe developmental delay and visual impairment. Dylan cannot move or speak and is fed through a tube into his stomach.
The family’s birth injury attorney said the parents seek to settle the matter out of court but there are significant differences of opinion about Dylan’s life expectancy and the damages payment that he is entitled to receive. The exact amount of money the family is seeking has not been disclosed. Dylan’s disabilities require around-the-clock care and long-term needs associated with his birth injury.
