Maryland Assembly Recommends Birth Injury Fund

According to the Baltimore Sun, a Maryland task force, for the second time in two years, has recommended that the state create a birth injury fund for babies born with neurological complications. Image of child in wheelchair

The fund would be modeled after state funds like those in Virginia and Florida—most patient advocates and injury attorneys oppose these measures. Opponents, including the Maryland Association for Justice, say the fund would be “unfair to victims who should be able to seek accountability in a public forum that holds providers responsible for care provided.”

The fund would need Legislative approval during the 2016 year in order to operate. Follow our blog and we will update you if more news about the legislative push comes out.

Do I Need a Birth Injury Attorney?

We strongly oppose sate efforts to create birth injury funds, because care for children who have experienced complications is often costly. A state fund may limit the amount of money victims can receive for care. Birth injuries resulting from malpractice include deformities, brain damage, cerebral palsy, erb’s palsy and shoulder dystocia.
