A Michigan jury awarded a family more than $130 million in damages after a child suffered severe brain injuries during the months after his birth resulting in cerebral palsy. 
According to the Detroit Free Press, the verdict was announced last month in Oakland County. The child reportedly suffered injuries while in the care of a Royal Oak medical facility.
The verdict was reached following a three week trial. It is believed to be one of the largest medical malpractice verdicts in Michigan history.
The family alleged that the boy was born prematurely, having developed a urological condition prior to his birth that would need to be investigated after he was born. He was scheduled to undergo a renal scan in the weeks after his birth, but workers had trouble establishing an IV line needed to perform the task.
During the renal scan event, the mother attempted to tell officials that the child was turning blue following the complication with the IV line, but claims officials failed to immediately call for assistance. The child’s condition immediately deteriorated and rescue attempts had to be performed. It was later discovered that he suffered a lack of oxygen and blood to his brain during the process. The child now needs full-time care due to his brain injuries.
Jurors sided with the family, finding that the medical facility failed to act appropriately and call a code blue during the event; it also found that it failed to give chest compressions, as required by the standard of care after the boy started showing distress symptoms.
