Family Sues United States After Baby Suffers Brain Injuries
According to Courthouse News Service, a federal judge has ordered the United States to pay more than $28 million to the family of a boy who suffered severe brain injuries when doctors failed to performed a timely Caesarean section (c-section). The news outlet reported that U.S. District Judge David R. Herndon entered judgment on December 20 for Sean Cobbs and his parents Patoya Bryant and Sean Cobbs Sr. The case took place in East St. Louis, Illinois. According to Courthouse News Service, the judgment “includes $3,216,827 for lost earnings, $15,165,708 for future care, $231,713 for past medical expenses, $5 million for loss of normal life, $3 million for pain and suffering, $2 million for disfigurement, $1 million for risk of future harm and a setoff of $1.6 million from a settlement with Southern Illinois Hospital Services.” The family reportedly sued the United States under the Federal Tort Claims Act, citing…

Delays in Genetic Testing at Hospitals Putting Babies at Risk
Last month, the Denver Post reported that hospital delays across the country are putting babies at risk for disabilities. While it may seem obvious, the Post article had some alarming statistics and examples of delays relating to birth and genetic testing that were baffling. According to the Post, nearly every baby born in the U.S. has its blood collected within a day or two following birth, to be screened for genetic and metabolic disorders. This is done so disorders can be detected quickly, averting possible death or limiting brain damage and further disabilities. However, according to the Post, many healthcare providers are having issues with the speed or processing times associated with testing. Family of 12-Year-Old with Cerebral Palsy Receives Over Two Million in Lawsuit
Twelve-year-old Roisin Conroy sued obstetrician John Corristine of Midland Regional Hospital for birth trauma suffered in 2001. Roisin has dykinetic cerebral palsy. She communicates only with her eyes and requires a wheelchair for mobility. As such, she sued the doctor through her mother, Mary Conroy. The family won €2.6 million, an apology, and an admission of liability. Corristine’s apology read, “I am instructed by the defendants and it is a term of the settlement to express their sincere apologies for the failings that caused injuries to Roisin Conroy and the consequential trauma experienced by Roisin and her family. They understand that neither this apology nor the financial compensation granted by the Court can negate the continuing heartache that the Conroy family must feel every day and appreciate that this continues to be a very difficult time for them.” Mary Conroy’s birth to Roisin was fraught with negligence.
