Birth Injury Victims Get Compensation From a State Neurological Fund
According to Beckers Hospital Review, the state of New York has agreed to pay medical bills for newborns who suffer brain injuries during birth. This will mean that the state, not the hospital, will be responsible for footing the bills. A new fund has been created in New York’s 2011-2012 budget to pay the newborns’ bills. Supports of the fund say the change will reduce medical malpractice premiums. However, the critics say the fund will create an unnecessary layer of burden on the state and forgive hospital for avoidable medical errors. The fund plans to cover all newborns who experience a brain or spinal cord injury due to oxygen deprivation or mechanical injury during labor, delivery or resuscitation. Hospital Watchdog Warns of Early Cesarean Deliveries and Birth Injuries
The Leapfrog Group, a voluntary patient-safety program, said that early elective deliveries might put infants at an increased risk of birth injuries. The group presented its finding to inform parents-to-be about the risks of elective early deliveries. The group states some hospitals across the country are delivering 40 percent of newborn babies early for no medical reason. Among the 773 hospitals in the United States, the group found a wide range of inconsistencies between how often facilities performed early elective deliveries. Additionally, allowing early deliveries may result in higher birth injury, infant mortality rates and permanent health problems, the group claims. An early elective delivery is a cesarean section, a surgical procedure made through a pregnant mother’s abdomen to deliver a baby. Ohio Family Fights for Daughter With Cerebral Palsy
According to About Lawsuits, in December, an Ohio judge rejected a new trial request regarding a medical malpractice lawsuit involving cerebral palsy. Previously, $13.9 million dollars were awarded in the case where the doctor was found guilty of causing cerebral palsy due to issues that occurred during delivery. Cerebral palsy occurs after an injury to an infant’s brain, resulting in a lack of oxygen to the brain during or soon after birthing. This can result in developmental issues including loss of motor functions and various additional issues that occur with cerebral palsy. However, in some children, cerebral palsy may also occur for other reasons aside from medical mistakes. The child affected, now aged 10, suffers from cerebral palsy due to birth injury that occurred due to a forced vaginal birth.
