Parents File $50 Million Birth Injury Suit Against Hospital
Each moment counts when delivering a baby, especially when things start to go wrong. A recent federal tort lawsuit filed in California alleges that one hospital’s mistake caused $50 million worth of permanent brain damage to a child. When Stefanie Davis went into labor in January of 2010, doctors determined that a vaginal birth was out of the question due to the baby’s position. The attending physician performed a C-section with a vacuum extraction, which many health experts acknowledge poses certain health risks to the baby. The procedure involves placing a small vacuum on the baby’s head to aid its removal from the womb. After removing the baby, nurses noticed signs of distress on the child where the doctor applied the vacuum, such as bruising, swelling and hemorrhaging. Nerve Transfers Prevent Disability After Birth Injury, Study Says
A new study published in the Journal of the American Academy of Orthopaedic Surgeons says that certain surgeries, if performed immediately after nerve damage occurs, can prevent serious injury later on. “If we get these patients late, any nerve surgery is less likely to work,” said Steve K. Lee, lead author of the study. Lee also is the research director at the Center for Brachial Plexus and Traumatic Nerve Injury at Hospital for Special Surgery. “A big thrust of this paper is to get the information out there that we need to see these patients earlier for better outcomes.” Hope for Birth Trauma Victims This information is especially relevant for the parents of newborns who may have sustained nerve damage at birth. $21 Million Award in Cerebral Palsy Lawsuit
Jaylan Norfleet is 9 years old. His family’s lawyer says he is “cognitively and mentally” fine, but he struggles with physical tasks. He has trouble moving his legs and controlling his arms. This is because he was born with cerebral palsy, a series of conditions that can affect motor control and cognitive development, often caused by complications during childbirth. According to a Baltimore jury, the hospital is to blame for Jaylan’s disability. Jaylan’s family was recently awarded $21 million in a lawsuit accusing the hospital of negligence during childbirth. The family claims that the Harbor Hospital made an error in judgment when doctors chose to deliver Jaylan via vaginal birth instead of cesarean, resulting in a lack of oxygen.
