Birth Trauma Attorneys Can Help Victims of Vacuum Extraction Injuries

Using a vacuum tool during delivery is a very risky decision for doctors to make. Two Pennsylvania parents say that doctors made a series of mistakes – including using a vacuum – during their child’s birth that led to his death. Mark and Cheryl Baiocchi filed a wrongful death lawsuit against St. Mary Medical Center, Dr. Traci Cook, the Women’s Specialists of Bucks County and Catholic Health East for medical negligence. Approximately 12 hours after arriving at the hospital, Dr. Cook used a Kiwi vacuum extraction device to remove the child during labor. The doctor used the device multiple times even though it was not necessary, according to the lawsuit. The vacuum raised the child’s heart rate, causing heart tone tachychardia. The child’s shoulder became stuck, causing shoulder dystocia. When he was born, he was “cyanotic, pulseless, apneic and floppy.” Doctors transferred him to St. Christopher’s Hospital for Children. Girl Born in Jail Suffers Birth Trauma Injuries

Wayne County has recently settled a birth trauma lawsuit filed by a woman who gave birth in jail. Chantrienes Barker went into labor in 1998 while incarcerated. Officers sent her to a hospital, but returned her to jail just two hours later. She and other inmates repeatedly urged guards to return her to the hospital, saying that her labor pains were increasing. She gave birth in jail, and her daughter now suffers from brain damage. Barker sued the county for violating her civil rights, and the county agreed to an $8 million settlement. The County’s Defense Initially, the county said that it was not responsible for the infant’s health due to a landmark abortion ruling. Since Roe V. Wade decided that life did not begin before birth, the county argued, jail officials had no responsibility to provide adequate care to Barker’s unborn child. Boy with Cerebral Palsy Who Talks with His Eyes Receives €1.4M Award

Gill Russell is six years old. He has cerebral palsy, he uses a wheelchair and the only way he can communicate is through his eyes (with the help of a special computer). His condition stems from a traumatic birth. Doctors used a vacuum to deliver his head, and his shoulder was stuck for 12 minutes. This resulted in his shoulder dystocia, a condition that affects limb movement. He sustained a brain injury during his birth. An Irish high court issued an apology and a €1.4M award for the traumatic birth that resulted in Gill’s disability, with the possibility of more damages to come. “The HSE (Health and Safety Executive) and staff at Cork University Maternity Hospital are truly sorry for your adverse experience,” the apology read.
