Forceps Cause Newborn Skull Fracture

A newborn in Ireland died a week after his birth due to a brain injury caused by forceps used in the delivery process. Claire McGovern, the baby’s mother, arrived at the National Maternity Hospital with painful contractions. She was almost 40 weeks pregnant, and doctors attempted to assist a natural birth with forceps. When the birth failed to progress, nurses took the mother upstairs to undergo a Caesarean section. Sadly, baby Daniel McGovern suffered a non-depressed fracture of the skull and a subgaleal hemorrhage of the brain, and he died a week later. Dr. Declan Keane, an obstetrician at the hospital, reported that he had “no doubt the fracture was most probably due to forceps.” He also commented that the entire delivery process would be improved if the delivery rooms were on the same floor as the operating rooms. Ohio Family Fights for Daughter With Cerebral Palsy

According to About Lawsuits, in December, an Ohio judge rejected a new trial request regarding a medical malpractice lawsuit involving cerebral palsy. Previously, $13.9 million dollars were awarded in the case where the doctor was found guilty of causing cerebral palsy due to issues that occurred during delivery. Cerebral palsy occurs after an injury to an infant’s brain, resulting in a lack of oxygen to the brain during or soon after birthing. This can result in developmental issues including loss of motor functions and various additional issues that occur with cerebral palsy. However, in some children, cerebral palsy may also occur for other reasons aside from medical mistakes. The child affected, now aged 10, suffers from cerebral palsy due to birth injury that occurred due to a forced vaginal birth. Belleville Family Sues Doctor and Hospital for Birth Injury

According to the Madison St. Clair Record, Jennifer and Lance Schenider filed a lawsuit against Protestant Memorial Medical Center doing business as Memorial Hospital and Dr. Michael E. Herrmann. The parents allege their daughter, Sophia Schenider, suffered a brain injury during the birth process and action of both hospital and doctor caused her cerebral palsy. The Scheniders claim their daughter was born with hypoxic brain injury, which is when the brain does not receive enough oxygen during the birthing process. Because of her brain injury, Sophia developed cerebral palsy. Sophia lost enjoyment of a normal life and sustains disfigurement, disability, pain and suffering, according to the complaint. Sophia Schenider has no ability to become adequately educated, has suffered impaired earning capacity, and will continue to incur large medical costs, the lawsuit states.
