A woman in Massachusetts gave birth to a baby with cerebral palsy. She filed a lawsuit against the doctors and the hospital, claiming that a series of medical mistakes led to her child’s disability. Pitocin The doctors administered Pitocin, a drug intended to speed up a prolonged labor. Sometimes the drug speeds up contractions so fast that the baby does not receive enough oxygen during birth. Lack of Attention The lawsuit claims that the doctors on staff did not closely monitor the woman or her child’s vital signs, and they did not notice that the Pitocin had raised her contraction rates to dangerous levels. In September, we blogged about selective dorsal rhizotomy (SDR), a type of spinal surgery that allows children with cerebral palsy to walk. The surgery, while expensive, often produces successful results. After raising over £60,000, a family in the United Kingdom can send their son to the United States for the SDR operation. Nicholas Bamforth, 9, has cerebral palsy. He and his family hope that the SDR operation will allow him to walk and possibly play football for his school team, fulfilling a lifelong dream. His family is planning on flying to the U.S. and staying for five weeks while he recovers from the operation. His family is still raising money to cover his physiotherapy that will likely continue long after the operation. Irish Family Compensated for Lost Earnings Due to Son’s Cerebral Palsy
Catherine Kenny had big plans for her son, Shane. They live on a farm, and Shane was set to be the sole inheritor of the farm. He would oversee every task on the family’s 168 acres, which is valued at €2.3 million. When he became too old, he would sell the farm or pass it along to his children. Unfortunately, doctors made a mistake during Shane’s birth that led to his cerebral palsy. Due to his disability, he cannot work on the farm. Catherine filed a birth trauma lawsuit on behalf of her son to reclaim all the potential wages that he could have earned running the farm.
