Family Receives $4M Settlement in Birth Trauma Lawsuit

A family in Rhode Island received a $4 million settlement from a hospital that they claim made decisions immediately after the birth of their child that led to his permanent brain damage. According to the birth trauma lawsuit, the birth was normal. The child did not respond to breastfeeding, so the doctor asked nurses to feed the child formula. They did not adhere exactly to the doctor’s orders, and the baby suffered a hypoglycemic episode. The parents say the episode caused brain damage that lead to continuing problems with vision, tactile sensory disorders and developmental issues. The child is now seven years old and still experiences these issues. By ignoring warning signs and risk factors of hypoglycemia such as low birth weight and poor response to breastfeeding, the parents say the hospital is responsible for their child’s current difficulties. New Center Offers Help for Adults with Cerebral Palsy

The term “cerebral palsy” refers to a wide range of conditions. Some people with cerebral palsy can function independently and live a high-profile life, like Breaking Bad actor RJ Mitte and marathon runner Bonner Paddock. Others, like Gwen and Eliza Gort, might be unable to move, walk, speak or eat without assistance, and they will need help for the rest of their lives. There are many pediatric resources to help infants and children with cerebral palsy, but as children grow older, options become sparse. To fill this need, Debby and Peter Weinberg donated $7 million to the Columbia University Medical Center to set up the Weinberg Family Cerebral Palsy Center. The Center will provide treatment to cerebral palsy patients of all ages. The center will also have facilities for research and education about cerebral palsy. Boy with Cerebral Palsy Who Talks with His Eyes Receives €1.4M Award

Gill Russell is six years old. He has cerebral palsy, he uses a wheelchair and the only way he can communicate is through his eyes (with the help of a special computer). His condition stems from a traumatic birth. Doctors used a vacuum to deliver his head, and his shoulder was stuck for 12 minutes. This resulted in his shoulder dystocia, a condition that affects limb movement. He sustained a brain injury during his birth. An Irish high court issued an apology and a €1.4M award for the traumatic birth that resulted in Gill’s disability, with the possibility of more damages to come. “The HSE (Health and Safety Executive) and staff at Cork University Maternity Hospital are truly sorry for your adverse experience,” the apology read.
