Jury Awards Over $2 Million in Erb’s Palsy Lawsuit
Prenatal care issues during the delivery of a child were at the center of a recent medical malpractice lawsuit on the East Coast. The recent New York lawsuit involved a child that was not given proper care, and a certified midwife that pulled too hard on the child’s head during delivery. The child’s mother filed a medical malpractice lawsuit on behalf of her now 7-year-old daughter who suffers from Erb’s palsy. The child has limited mobility in her left arm due to permanent nerve damage to nerves in her neck. The lawsuit alleged that issues involved during the child’s prenatal care and the delivery process caused the permanent nerve damage. Birth Injury Victims Get Compensation From a State Neurological Fund
According to Beckers Hospital Review, the state of New York has agreed to pay medical bills for newborns who suffer brain injuries during birth. This will mean that the state, not the hospital, will be responsible for footing the bills. A new fund has been created in New York’s 2011-2012 budget to pay the newborns’ bills. Supports of the fund say the change will reduce medical malpractice premiums. However, the critics say the fund will create an unnecessary layer of burden on the state and forgive hospital for avoidable medical errors. The fund plans to cover all newborns who experience a brain or spinal cord injury due to oxygen deprivation or mechanical injury during labor, delivery or resuscitation. Meanwhile, families of injured newborns will need to file lawsuits and prove medical negligence in court. Families that win a judgment will receive coverage for lifetime medical costs from the state. Family awarded $9.5M medical malpractice settlement for boy with cerebral palsy
An Illinois family has agreed to a $9.5M medical malpractice settlement after mediation with an Illinois hospital, nurse midwife and the nurse’s employer after she claimed that her son’s birth injury, resulting in cerebral palsy, was caused by negligence. The woman filed a cerebral palsy lawsuit claiming her son was deprived of oxygen during the birth process which caused a brain injury. According to her lawsuit, the nurse midwife was required to have a sponsoring physician on call but her sponsoring physician was away and she did not call another physician in to the case. The child, who is now 14, has a permanent disability which requires lifetime care. In the settlement, the hospital has greed to pay $7.5 million.
